In 2005, Curtis McGhee and another individual brought claims against the City alleging violations of civil rights sounding in malicious prosecution. The City sought coverage under insurance policies issued by CIC and Columbia. On appeal, the City and McGhee challenged the district court's order granting summary judgment to CIC and Columbia, on CIC's and Columbia's declaratory judgment claims concerning coverage under the various insurance policies. The court concluded that the district court correctly refused to consider and correctly denied additional discovery of extrinsic evidence. The court also concluded that the alleged malicious prosecution and resulting personal injuries occurred when the underlying charges were filed against McGhee in 1977. Therefore, the court affirmed the district court's judgment that the following policies did not afford coverage to the City for the malicious prosecution claims: the two excess liability policies issued by CIC; four of the special excess liability policies issued by Columbia; and the commercial umbrella liability policy issued by Columbia. As to the 1977-78 special excess liability policy issued by Columbia, the court reversed the district court's judgment regarding the applicability of the reasonable expectations doctrine. Defendants' convictions arose out of a series of events that took place while Defendant Robles was Treasurer of the City of South Gate, California. Robles, along with Defendant Garrido, a local businessman and friend, were implicated in two schemes to award city contracts to particular companies while reaping substantial benefits for themselves. On appeal, defendants challenged their convictions. In light of the the Supreme Court's decision in Skilling v. United States, which narrowed the scope of 18 U.S.C. 1346 to include only honest services fraud based on bribery and kickback schemes, the court reversed Robles's and Garrido's honest services fraud convictions and reversed Robles's money laundering convictions. The court affirmed Robles's bribery convictions under 18 U.S.C. 666 because such convictions did not required the defendant to be engaged in an official act. Taylor owned a convenience store. In 2008, the store received authorization to redeem benefits through the Supplemental Nutrition Assistance Program, a federally funded program providing nutritional assistance to needy individuals. In 2010-2011, the USDA conducted an undercover operation. Taylor allowed undercover police officers and confidential informants working under USDA special agents to redeem SNAP benefits for cash that Taylor knew would be used to purchase illegal drugs. Taylor once exchanged a firearm for SNAP benefits. Taylor pled guilty to conspiracy to defraud the U.S., SNAP fraud, drug distribution, and being a felon in possession of a firearm. Based on the firearm conviction and Taylor’s criminal history, the probation officer recommended an enhanced sentence under the Armed Career Criminal Act, 18 U.S.C. 924(e), resulting in a Guidelines range of 188 to 235 months. The district court sentenced Taylor to 188 months. Graves, a friend of Taylor’s, worked in the store and would stand outside the store and either sell drugs to people who redeemed benefits for cash or tell them where to find drugs. Graves also sold an informant a firearm and split the proceeds with Taylor’s wife. The district court sentenced Graves to 200 months. The Sixth Circuit affirmed. View "United States v. Stoerr pled guilty to bid rigging, 15 U.S.C. 1; conspiracy to provide kickbacks and to defraud the United States, 18 U.S.C. 371; and assisting in the preparation of false tax returns, 26 U.S.C. § 7206(2). The convictions stemmed from kickback payments that Stoerr solicited and accepted from sub-contractors in connection with environmental remediation projects managed by Sevenson, his employer from 1980 to October 2003. In total, the district court determined that the scheme resulted in losses of $134,098.96 to the EPA and $257,129.22 to Tierra. After Sevenson learned of the kickbacks scheme, it paid Tierra approximately $241,000 to compensate for its losses. It then commenced a civil action against Stoerr in state court to recover its losses, and sought restitution in connection with Stoerr’s sentencing, under the Mandatory Victims Restitution Act, 18 U.S.C. 3663A, for reimbursement of the amount that it paid to Tierra. The district court denied Sevenson‟s request for restitution, instead ordering that Stoerr pay restitution to Tierra. The Third Circuit dismissed; as a non-party, Sevenson lacks standing to appeal. Watkins, an African-American, worked for the school district, overseeing security systems. Fultz supervised Watkins and, relying on Watkins’s advice, Fultz awarded Vision a $182,000 annual contract for service of security cameras. Vision’s president, Newsome, testified that Watkins called her and talked about a “finder’s fee.. Newsome went to Cleveland for a customer visit. She e-mailed Watkins and he replied: “Absolutely$.” Newsome believed that Watkins expected her to pay him at their meeting. Newsome notified Fultz. At the meeting, Watkins requested “an envelope.” After Fultz contacted police, the FBI recorded meetings at which Newsome gave Watkins $5,000 and $2,000. A white jury convicted on two counts of attempted extortion “under color of official right” (Hobbs Act, 18 U.S.C. 1951), and one count of bribery in a federally funded program, 18 U.S.C. 666(a)(1)(B). The court determined a total offense level of 22, applying a two-level enhancement for obstruction of justice, another two-level enhancement for bribes exceeding $5,000, and a four-level enhancement for high level of authority, plus an upward variance of 21 months under 18 U.S.C. 3553(a), and sentenced Watkins to six years’ incarceration. The Sixth Circuit affirmed, rejecting challenges to jury instructions, sufficiency of the evidence, the jury’s racial composition, and the reasonableness of the sentence.View "United States v. When Defendant Ralph Merrill sold millions of rounds of ammunition to the United States Army, he concealed that the ammunition was manufactured by a Communist Chinese military company because his contract with the Army prohibited the delivery of that kind of ammunition. Defendant had the ammunition repackaged which made it unsafe for later use. Defendant was convicted for conspiracy to commit false statements, major fraud, and wire fraud against the United States and for major fraud and wire fraud. On appeal, Defendant argued that the district court misinterpreted the regulation that prohibited the Department of Defense from acquiring munitions manufactured by a Communist Chinese military company, that the regulation did not apply to the ammunition he sold, and that he did not defraud the government because he did not misrepresent a material fact when he lied about the origin of the ammunition. Upon review, the Eleventh Circuit concluded Defendant's arguments failed because his interpretation of the applicable statutes was flawed and, "more fundamentally, is irrelevant to his misconduct." Because all of Defendant's arguments failed, the Court affirmed his convictions. View "United States v. Merrill" on Justia Law

Defendant threatened to reveal office gossip that the General Counsel of the New York State Comptroller's Office was having an affair unless the General Counsel recanted a recommendation to the State Comptroller to reject a proposal by defendant's company. He was convicted of attempted extortion of the office under the Hobbs Act, 18 U.S.C. 1951(a), and interstate transmission of extortionate threats in violation of 18 U.S.C. 875(d). The Second Circuit affirmed, rejecting his argument that his conduct did not come within the statutory definition of extortion because he did not "attempt to obtain property" from the General Counsel. Andrews was designated as contractor for improvements to the sewage system, in a no-bid process involving kickbacks and bribery, having made numerous false statements in the bond application package. After the contract was terminated, he submitted a claim of $748,304, based on false statements and duplicate charges. Evidence indicated that Andrews was not capable of the project work and that the entire scheme was fraudulent. He was convicted of one count of conspiracy, 18 U.S.C. 371, four counts of wire fraud, 18 U.S.C. 1343, 1346, and 2, one count of program fraud, 18 U.S.C. 666(a)(1)(B) and 2, one count of making a false claim upon the Government of the Virgin Islands, 14 V.I.C. 843(4), and one count of inducing a conflict of interest, 3 V.I.C. 1102, 1103, and 1107. The Third Circuit affirmed the conviction, but remanded for resentencing. Errors in the indictment and jury instructions concerning honest services fraud did not affect substantial rights. Although the 151-month term of imprisonment was within the statutory maximum for Counts Two through Five, it exceeded the statutory maximum for Counts One and Six; it was not possible to determine whether the sentence was legal as to each count View "United States v. Two U.S. Army Reserve officers, deployed to Iraq in 2003 to work for the Coalition Provisional Authority, were convicted of conspiracy under 18 U.S.C.371, for participating in a bid-rigging scheme that involved directing millions of dollars in contracts to companies owned by an American businessman. The Third Circuit affirmed, rejecting challenges to the sufficiency of the evidence to establish participation in the conspiracy; to denial of a motion to suppress; and to denial of immunity for a co-conspirator. Defendant accepted $1,000 and Mets tickets for helping a consulting company obtain a contract with the county for temporary employment of individuals for clean-up after a 2006 flood. He pled guilty to violating 18 U.S.C. 666(a)(1)(B). The presentence report recommended a sentence of 15 to 21 months' imprisonment. USSG 2C1.2(a)(1) set the base offense level at 11; the report added two levels under 2C1.2(b)(1) because the offense involved more than one gratuity and four levels under 2C1.2(b)(3) because the offense involved a public official in a high-level decision-making or sensitive position. It subtracted three levels for acceptance of responsibility (3E1.1). The district court imposed a sentence of 15 months' imprisonment. The Third Circuit affirmed. Defendant could not hire or fire; could not bind the county; could not act officially on the county's behalf; had administrative, not policymaking, duties; and reported to superiors, who reported to County Commissioners. The high-level government official enhancement was not applied to his superior, also implicated in the bribery scheme. Defendant was, however, responsible for the human resource department.
