Dougherty, the Business Officer for Operations for the Philadelphia School District, was accountable for the Office of Capital Programs (OCP), which developed projects for School Reform Commission (SRC) approval. Dougherty reported to Nunery, who reported to Superintendent Ackerman. Ackerman directed OCP to install security cameras in “persistently dangerous” schools. Due to a short time frame, OCP could not use its bidding process and was required to select a pre-qualified contractor. Dougherty identified SDT as such a contractor, prepared a proposal, and submitted a resolution to Nunery. Under District policy, the Superintendent must approve the resolution before it is presented to the SRC. Dougherty did not receive a response from Nunery or Ackerman, nor was the resolution presented to the SRC. Ackerman allegedly rejected the SDT proposal for lack of minority participation, and directed that IBS, a minority-owned firm, be awarded the contract. IBS was not pre-qualified. SRC ratified the plan. Conflicts arose. Dougherty met with reporters, resulting in articles accusing Ackerman of violating state guidelines, and contacted the FBI, state representatives, and the U.S. Department of Education. Ackerman placed Dougherty on leave pending an investigation, which concluded that there was no unlawful motive in the contract award, but that Dougherty violated the Code of Ethics confidentiality section. SRC terminated Dougherty. In his suit, alleging First Amendment retaliation and violations of the Pennsylvania Whistleblower Law, the district court denied motions for summary judgment on the basis of qualified immunity. The Educational Rate Program, a subsidy program authorized by the Telecommunications Act of 1996, is implemented by the FCC, which established USAC, a private non-profit corporation, to administer the Program. USAC provides subsidies to eligible school districts for the cost of telecommunication services. FCC regulations require that providers offer schools the “lowest corresponding price” (LCP) for their services: the “lowest price that a service provider charges to non-residential customers who are similarly situated to a particular school, library, or library consortium for similar services.” Heath operates a business that audits telecommunications bills and was retained by Wisconsin school districts. Heath found that certain schools paid much higher rates than others for the same services. As a result, many districts did not receive the benefit of LCP and the government paid subsidies greater than they should have been. Heath informed Wisconsin Bell of the discrepancy, but it refused to provide the more favorable pricing. Heath also learned of an even lower price charged to the Wisconsin Department of Administration (DOA). Heath filed a qui tam lawsuit. The government declined to intervene. The district court dismissed for lack of subject matter jurisdiction, finding that the public disclosure bar applied and that Heath was not saved by the original source exception, because the DOA pricing was on its website. The Seventh Circuit reversed, stating that the claim was not based on the DOA website information and that Heath was not an opportunist plaintiff who did not contribute significant information. After a hearing, the Department of Children and Families substantiated allegations that Plaintiff, an elementary school teacher, emotionally abused one of his students and recommended that Plaintiff’s name be placed on the Department’s central registry of child abuse and neglect. The trial court affirmed, ruling that the ultimate finding of the administrative hearing officer was supported by substantial evidence. The Appellate Court reversed and ordered the Department to remove Plaintiff’s name from the central registry. The Supreme Court reversed, holding that the Appellate Court (1) failed properly to credit the factual findings and legal conclusions of the administrative hearing officer; and (2) improperly concluded that the definition of “abused” found in Conn. Relator filed suit against certain student loan corporations, alleging that they defrauded the Department of Education and thus violated the False Claims Act (FCA), 31 U.S.C. 3729 et seq. After applying the arm-of-the-state analysis on remand, the district court again concluded that all of the student loan corporations constituted state agencies not subject to suit under the Act and granted their motions to dismiss. Applying the arm-of-the-state analysis to the corporations, the court vacated the judgment of the district court as to PHEAA and remanded to permit limited discovery on the question of whether PHEAA was truly subject to sufficient state control to render it a part of the state; vacated the judgment with respect to VSAC and remanded to permit limited discovery; and affirmed the judgment with respect to ASLA because it is an arm of Arkansas and therefore not subject to suit under the FCA. Defendant, a school district, leased portable classrooms from plaintiff under contracts including penalties for early cancellation or default. Under the Downstate School Finance Authority for Elementary Districts Law (105 ILCS 5/1F-1) the state later created the Authority to manage the District's finances. The Authority canceled the leases before expiration, but did not authorize payment of the cancellation fees. The trial court granted summary judgment, finding it was legally impossible for the District to pay the cancellation fees, but also finding that the Authority had to comply with the cancellation terms of the leasing contracts. The appellate court affirmed the judgment in favor of the District on the cancellation fees and vacated as moot the declaratory judgment in favor of plaintiff. The Illinois Supreme Court concluded that the legislature intended the Act to permit the Authority to cancel a school district's contract with a third party, but that cancellation must be consistent with the contractual terms agreed to by the school district and the third party. LTTS Charter School ("LTTS") was an open-enrollment school that retained C2 Construction, Inc. ("C2") to build school facilities at a site Universal Academy had leased. C2 filed a breach of contract suit and Universal Academy filed a plea to the jurisdiction claiming immunity from suit. The trial court denied the plea and Universal Academy brought an interlocutory appeal under Section 51.014(a)(8) of the Civil Practice and Remedies Code. In the court of appeals, C2 moved to dismiss the interlocutory appeal, arguing that Universal Academy was note entitled to one because it was not a governmental unit under the Torts Claims Act ("Act"), Tex. Civ. Prac. & Rem. Code 101.001(3)(D). At issue was whether an open-enrollment charter school was a governmental unit as defined by Section 101.001(3)(D) and thus, able to take an interlocutory appeal from a trial court's denial of its plea to the jurisdiction. The court held that open-enrollment charter schools were governmental units for the Act purposes because the Act defined government unit broadly to include any other institution, agency, or organ of government derived from state law; the Education Code defined open-enrollment charters schools as part of the public school system, which were created in accordance with the laws of the state, subject to state laws and rules governing public schools and, together with governmental traditional public schools, have the primary responsibility for implementing the state's system of public education; and the Legislature considered open-enrollment charter schools to be governmental entities under a host of other laws outside the Education Code. Accordingly, because Universal Academy was a governmental unit under the Act, the court of appeals had jurisdiction to hear its interlocutory appeal under Section 51.014(a)(8).View "LTTS Charter School, Inc. v. The pro se plaintiff filed a qui tam suit against the university and nine chemistry professors, charging that they defrauded the United States in violation of several federal statutes by obtaining federal grant money on the basis of plagiarized research papers. He does not allege that the fraud harmed him, but apparently sought a “bounty,” 37 U.S.C. 3730(d)(1-2). The district court dismissed. The Seventh Circuit affirmed, stating that to maintain a suit on behalf of the government, a qui tam plaintiff has to be either a licensed lawyer or represented by a lawyer. ITT is a for-profit institution with more than 140 locations and offers post-secondary education. Leveski, who worked at the ITT campus, alleged, under the qui tam provisions of the False Claims Act, 31 U.S.C. 3730(b) that ITT knowingly submitted false claims to the Department of Education to receive funds from federal student financial assistance programs under the Higher Education Act, 20 U.S.C. 1001. The district court dismissed for lack of jurisdiction, finding that the allegations had already been publicly disclosed and that Leveski was not the original source of the allegations. The court granted sanctions of $394,998.33 against Leveski's lawyers. The Seventh Circuit reversed, finding the allegations that ITT paid illegal incentive compensation throughout Leveski’s employment as a recruiter and financial aid assistant, sufficiently distinct from prior public disclosures to give the court jurisdiction. The court noted the lack of temporal overlap with allegations by other ITT employees and Leveski’s more detailed allegations. View "Timothy J. Matusheski v. Hill, Director of Risk Management for Detroit Public Schools invited Washington to submit a proposal for a wellness program for DPS employees. Washington and others joined Associates for Learning (A4L) and submitted a proposal quoting $150,000 for a pilot study. Contrary to DPS policy, Hill did not open competitive bidding or execute a written contract, and made payments by wire transfer, rather than by check. Hill, who later left DPS testified that he met with Washington to discuss larger amounts. Washington paid Hill five percent of the invoice amount for assistance in getting the invoices paid. Invoices totaling more than a million dollars for “future work” were paid. The partners met in public places to distribute cash. Washington was convicted of conspiracy to commit program fraud, 18 U.S.C. 371 and 666, and conspiracy to commit money laundering, 18 U.S.C. 1956. The district court enhanced Washington’s base offense level by 22 levels, finding that Washington was an “organizer or leader” and that the amount of loss to DPS was more than $2.5 million, and sentenced her to 84 months. The Sixth Circuit affirmed, finding that Washington was not prejudiced by errors made by counsel and that the evidence was sufficient. View "United States v. Washington" on Justia Law

In 2011, the Wisconsin Legislature passed Act 10, a budget repair bill proposed by recently-elected Governor Walker. Act 10 significantly altered state public employee labor laws, creating two classes of public employees: “public safety employees” and all others, “general employees.” The Act prohibited general employees from collectively bargaining on issues other than “base wages,” imposed rigorous recertification requirements on them, and prohibited their employers from deducting union dues from paychecks. The Act did not subject public safety employees or their unions to the same requirements. The enactment was controversial and received nationwide publicity. Unions filed suit, challenging the limitations on collective bargaining, the recertification requirements, and a prohibition on payroll deduction of dues, under the Equal Protection Clause. They also challenged the payroll deduction provision under the First Amendment. The district court invalidated Act 10’s recertification and payroll deduction provisions, but upheld the limitation on collective bargaining. The Seventh Circuit held that the Act is valid in its entirety. Act 10 is viewpoint-neutral and, while “publicly administered payroll deductions for political purposes can enhance the unions’ exercise of First Amendment rights, [states are] under no obligation to aid the unions in their political activities.” The classifications and recertification requirement survive rational basis review.
